Terms and Conditions

Tours conducted by Newton's Tours, a division of DCMS Ltd., 8875 Hidden River Parkway, Suite 300, Tampa, Florida 33637, 1-800-223-5469.Travel arrangements provided by Tour Center Inc., 1281 Peterson Plank Road, Secaucus, New Jersey, 1-800-222-1170. 

Responsibility: Newton's Tours/Tour Center Inc. acts as an agent in providing all services in connection with its tours .It cannot assume any responsibility for any injury, death, damage or loss due to delays, mechanical defects, o-r failure of any nature including aircraft, motorcoaches, vessels or any other means of conveyance or accommodations or other services resulting directly or indirectly from any act of God. Newton's Tours/Tour Center Inc. is exempt from acts of government, or other authorities de jure or de facto, wars (whether declared or not), hostilities, civil disturbances, strikes, riots, thefts, pilferage, epidemics, quarantines, medical or customs regulations, or procedures, defaults, delays, or cancellations. Tour member is responsible for conditions beyond the control of Newton's Tours/Tour Center Inc. for any loss or damage resulting from improperly issued passports, visas and travel documents.  Tour members must be in possession of a passport valid beyond the anticipated date of return home.  None of Newton's Tours/Tour Center Inc. affiliates shall become liable for any additional expenses or liability sustained or incurred by a tour member as a result of the foregoing causes.  Newton's Tours/Tour Center Inc. will, should circumstances warrant, alter the itinerary or the sequence of attractions visited and substitute hotels of a similar category.  If an entire trip is canceled by Newton's Tours/Tour Center Inc. for any reason whatsoever, all partial and/or full payments made will be refunded in full without any further obligation on its part.  If any tour member does not utilize any portion of the tour provided at any time, for any reason whatsoever, additional costs or substitutions shall be borne by the tour member. 

Included in the cost of the tour:  Round trip transatlantic airfare from Atlanta, Georgia, lodging, events as indicated, meals as indicated, ground transportation, all tips to hotel and restaurant staffs as per itinerary. Bottled water and soft drinks, transfers, sight seeing, baggage handling, hotel taxes, gratuities, entrance fees to museums and parks, escort services, airport departure taxes, travel insurance are included. Medical evacuation services including transportation to medical care facilities. Portage of one bag per person.   

Not included in the cost of the tour:  Passport fees, Departure taxes, U.S. Customs and immigration fees (approximately $100), laundry, room service, telephone calls, and beverages not provided on the itinerary, items from hotel room mini bars, items of a personal nature and excess baggage charges. This 14-day trip begins and ends on Saturday at the Atlanta International Airport. All expenses preceding departure from Atlanta and after returning to Atlanta are the sole responsibility of the tour member.

Tour Member Conduct: Newton's Tours/Tour Center Inc. reserves the right to cancel participation of an individual who’s actions or behavior impedes trip operations or the rights, welfare or enjoyment of other trip members.  A refund based on unused costs will be the limit of Newton's Tours/Tour Center Inc. responsibilities.

Safety and Security: Newton's Tours/Tour Center Inc. is not responsible for loss, damage, or theft of luggage and/or personal belongings or personal injury, accidents, and/or illness.  Baggage and belongings are at "Owner's Risk" throughout the tour.

Possible Changes in the Itinerary: Conditions may change between the time a service or facility is selected and the time of travel over which we have no control.  Newton's Tours/Tour Center Inc. or its agents reserve the right to substitute hotels of similar category or other services and to alter the itinerary to conform with local conditions and local government arrangements.

Tour Member Deviation from Schedule:  The cost of any deviation from scheduled activities, by a tour member,  will be that individual's responsibility.  The cost of this tour is based on group participation and the cost of unused meals or services cannot be refunded. 

Cancellations and Refunds:  Full refund, less a $100 per person administrative fee will be provided to those who cancel up to 90 days prior to the trip.  50% of the tour cost will be refunded if cancellation occurs between 90 and 60 days prior to the trip.  25% of the tour cost will be refunded if cancellation occurs between 60 and 30 days prior to the trip.  No refund will be provided if cancellation occurs after 30 days prior to the trip.   This policy is based upon Newton's Tours/Tour Center Inc. responsibility to pay its vendors 60 days prior to the trip.  Cancellations must be made in writing: verbal cancellations whether in person or by telephone, are not valid.  Written cancellations should be sent to Newton's Tours/Tour Center Inc., 8875 Hidden River Parkway, Suite 300, Tampa, Florida 33637. 

Newton's Tours/Tour Center Inc.  reserves the right to cancel any trip prior to departure for any reason whatsoever including insufficient group sign-up or logistical problems (e.g. acts of God, war, strikes, natural calamities, etc.) which may impede trip operations.  The refund of all payments received shall release Newton's Tours/Tour Center Inc. from any further liability.  Newton's Tours/Tour Center Inc. is not responsible for expenses incurred by tour members in preparation for the trip (e.g., visa fees, equipment, etc.) or for any other arrangements made by tour member prior to departure date.  Except for verifiable, extenuating circumstances, refunds are not made for any missed tour services.  For verifiable claims to be considered they must be received in writing within 30 days of the termination of tour and be accompanied by supporting documentation verifying the claim adjustment.

Photography on Tours:  Newton's Tours/Tour Center Inc.  reserves the right to take photographs during the operation of any tour for promotional purposes.  By booking a reservation with Newton's Tours/Tour Center Inc., tour members agree to allow their images to be used in such photographs.  Tour members who prefer that their images not be used are asked to identify themselves to their tour guide.

Insurance: Travel insurance including Personal, Accident and Baggage will be included in the fee and is required for travel. Tour member must file application with their final payment. 

Tips and Taxes: The tour price includes South African service charges and taxes as posted by the hotels or local governments and one bag per person.  All tips to hotel staffs, and restaurant staffs as per itinerary are included. Tour members may tip in instances of exceptional services.

Release of liability and assumption of all risk:  I acknowledge that I have voluntarily applied to participate in the tour designated in this application.  I am voluntarily participating in this tour with the knowledge that travel to a foreign country and/or remote areas visited by this trip involves numerous risks and danger including, but not limited to: forces of nature, social conditions.  Newton's Tours/Tour Center Inc. will make every attempt to acquire medical attention where needed.  Newton's Tours/Tour Center Inc. will also provide travel to and from medical facilities and/or to an international airport for travel home. I acknowledge that the enjoyment and excitement is derived in part from some small risks of activities that go beyond the safety of life at home or work .I hereby assume any and all risks of illness, emotional trauma, injury, or death.
